XNow.com is owned and/or operated by ExperienceNow, Inc., a Delaware Corporation. “XNow,” "EN," "we," "us," "our" and similar references, as used herein, refer to XNow.com, ExperienceNow, Inc., our subsidiaries, divisions and affiliates, our related subdomains, our eligibility verification application (“Eligibility Application”), our owned and operated linked sites - some of which are private-label sites operated on behalf of our partners, third-party apps, and platforms (e.g., social media services) where our ticketing and travel products and services are distributed (our Eligibility Application, XNow.com website and related websites, and mobile applications are collectively referred to as the “Site”). Our Eligibility Application operates as a Verification-as-a-Service (VaaS) for access to the Site that, among other things, verifies user eligibility for exclusive offers, discounts, and programs, including students, seniors, teachers, alumni, active or Veteran Military, residents, first responders, among other populations or affinity segments. Automated VaaS Decision-Making (Quebec Law 25). If we use automated decision-making that produces legal or similarly significant effects concerning you—such as automated eligibility determinations—we will notify you of the use of such technology, explain the personal information involved, and provide options to request human review or to submit comments.

Your privacy is important to us, and we seek to be transparent about how we treat any information we collect from you or in connection with your use of the Site and the Eligibility Application. To help us make our Site more personal and valuable to you and to allow us to improve our Site, our interface, and navigation, we collect certain Personal Data as more fully described below. As part of our Site’s membership and eligibility verification process, we collect certain Personal Data, and we respect and protect your right to privacy as set forth in this privacy policy (“Privacy Policy”).

We are committed to protecting your privacy and being transparent about what we collect while creating a safe, trusted online destination for everyone visiting and using our Site.

This Privacy Policy describes how we collect, use, and disclose information via the Site. Certain services, which you may access via the Site, are provided by our third-party partners, and protection of your information relating to such services will be governed by the privacy policy of such third-parties. This Privacy Policy applies to our U.S. and Canadian operations, websites, SMS and mobile communications, and all other services provided by ExperienceNow.

By accessing, browsing and using the Site, you acknowledge you have read, understood and agreed to our Privacy Policy as described herein.

Information We Collect

We collect "Personal Data" that you provide directly—such as your name, email, phone number, gender, other eligibility credentials, as well as information automatically generated through your interactions with our website, applications, or text messages. We collect only the information necessary for verification, account management, fraud prevention, compliance, and customer support, consistent with both U.S. and Canadian privacy requirements.

"Personal Data" is any information that identifies you or would enable someone to contact you, and includes: name, address, e-mail, telephone number, account number, credit card information, and other relevant information you provide us to verify your eligibility to become a Site Member, conduct a transaction, deliver products and services, administer individual accounts, provide customer support or communicate with you regarding promotions, updates, or special offers we think may be of interest to you. While you are not required to submit any information to our Site, if you do not provide the requested information, you will not be able to register and become a Site Member or access or view prices or conduct transactions.

Information you provide

We collect Personal Data that you specifically and voluntarily provide to us to verify your eligibility to become a Site Member (via the Eligibility Application). We rely on third-party databases to verify this information through proprietary agreements for that specific purpose. We also license our online Eligibility Application system to our partners who offer benefits to you based on your eligibility status, for which you specifically seek access to such partners’ sites that offer discounts or other benefits based on such verified eligibility as confirmed by our Eligibility Application. When you successfully complete the Eligibility Application on a partner’s site you also benefit from becoming a Site Member of our Service.

You may voluntarily enroll yourself in our text message or “Short Message Service” (SMS) alert and communications program by providing your mobile telephone number (your “Personal Mobile Information”) and opting-in to the program. These messages will be used for notifications, confirmations, customer service, other relevant messages regarding your purchases, other communications requested by you. We take great precautions to keep the Personal Mobile Information you share with us safe and private. We will not disclose your Personal Mobile Information to any persons or entities outside of EN, nor lease, license, rent, transfer, disclose, disseminate or otherwise grant access to such information; provided, however, we use an outside unified SMS messaging platform to securely manage our SMS communications with our Site Members. We take commercially reasonable security measures to protect against unauthorized access to, or unauthorized alteration, disclosure or destruction of your Personal Mobile Information that you share, and we collect and store.

Carriers are not liable for delayed or undelivered messages. Our SMS is supported on all major carriers including but not limited to AT&T, Boost Mobile, T-Mobile, Metro PCS, Verizon Wireless, Sprint, U.S. Cellular, Cricket, and Virgin Mobile.

Automatically Collected Data

When you access or use the Site and Eligibility Application, we automatically collect information about your visit, including:

  • Log Information: We collect log information about your use of the Site, including the type of browser you use, access times, pages viewed, your IP address and the page you visited before navigating to our Site.

  • Device Information: We collect information about the computer or mobile device you use to access our Site, including the hardware model, operating system and version, unique device identifiers and mobile network information.

  • Location Information: With your permission, we may collect information about the location of your device when you access or use the Eligibility Application and Site or otherwise consent to the collection of this information. For more details, please see “Your Choices” below.

Information Collected by Cookies and Other Tracking Technologies

We use various technologies to collect information, including cookies. Cookies are small data files stored on your hard drive or in device memory that help us improve our Site and your experience, see which areas and features of our Site are popular and count visits. We also use cookies to obviate the need for you to re-verify your eligibility status on other sites that license our Eligibility Application. We may also include third-party cookies on our Site, and the collection, use and choice related to these third-party cookies can be found on such third-party sites. For more information about cookies, and how to disable them, please see “Your Choices” below.

Information We Collect from Other Sources

We may also obtain information from other sources and combine that with information we collect directly. For example, we may collect information about you from third-parties, including but not limited to information to complete our Eligibility Application to become a Site Member and associated identity verification services including Single Sign-On (SSO) conveniences such as Facebook. If you create or log into your account through a social media site or other site to access the Site, we will have access to certain information from those SSO sites, such as your name, account information and friends lists, in accordance with the authorization procedures determined by such social media site.

How We Use the Information We Collect

We use the Personal Data we collect primarily to provide you with a more personalized experience on our Site and our emails, to facilitate the products and services you purchase or use through your privileged access through our Eligibility Application (either directly or through third-parties), and to build features that will make the Eligibility Application and Site easier to use. We also use the information we collect to: communicate with you, including to provide customer service; monitor and analyze trends, usage and activities in connection with our services; detect, investigate and prevent fraudulent use and transactions and other illegal activities and protect the rights and property of XNow and others; and to personalize the Site including content or features that match user profiles or interests.

Sharing Your Personal Data

We will only share your Personal Data as described below:

XNow's Partners, Vendors and Providers

Many of the operations we perform require us to engage the technologies and services of other companies to help us better serve our users. For example, we retain companies to help us verify your identity and eligibility to become a Member and access the Site, handle mail and email, market our products and services, handle purchases of tickets to certain events or book travel, process credit card transactions, and provide customer service. The companies we retain to help us with these tasks have access to Personal Data solely to perform their functions and may not use it for any other purposes.

External Partners, Service Providers, Event Providers, and XNow Users

When you use XNow to purchase tickets or book travel, we may provide Personal Data to the associated merchant or fulfillment ticketing or booking service, team, venue, promoters, league, or other third-party involved in the sale of the ticket or booked travel. We may even ask you to transact directly with that third-party vendor. For example, when you purchase a ticket, we may share your Personal Data (excluding payment information) with the ticketing platform or exchange in order to complete the transaction. Similarly, when you purchase a ticket to an event (such as, but not limited to, a game or concert), we may provide your Personal Data to the associated teams, venues, the league, organization that sanctioned the game, a concert promoter, and/or the operator of the venue or facility that hosted the event or a travel booking service or direct provider. Additionally, we may share information with third-parties to assist in processing your payment with the seller. We may share your Personal data with those third-party product or service suppliers sold through or linked from the Site, such as hotels, car rental companies, travel providers, activity providers, entertainment providers, producers and box offices. By making a purchase or reservation through our Site, you are authorizing us to disclose to suppliers your Personal Data, except that we will not disclose financial information. You also agree that such suppliers may contact you for marketing purposes, including promotional and marketing emails from those suppliers. These suppliers are not controlled by EN and Personal Data shared with them is subject to the applicable supplier's privacy policy and security practices. We also license our online Eligibility Application to partners who use the system to offer discounts or privileged access to special offers to verified users who voluntarily provide their information to gain access to their pricing or offers based on their eligibility as confirmed by our Eligibility Application. Upon such eligibility confirmation, the user will also benefit by also becoming an Site Member. We provide some or all of the Eligibility Application information to such partners and may supplement that information with other information to help them better personalize their services for you. We retain that information and may update that partner’s information about you if your eligibility status changes (i.e., age group or a Student graduating). We encourage you to review the privacy policies and security practices of any supplier whose products or services you purchase through our partner site, this Site or linked from this Site.

Co-Branded Websites

If you are accessing the Site through a co-branded or white-label version of this Site developed on behalf of a third-party, such as a college or other partner that offers services to users who generally associate with the population segments we serve and verify eligibility, or some other referring business, we may share your name, physical address and email address with such third-party partners. We do not provide credit card or other financial information to these third-parties.

Third-Party Companies

We may enter into agreements with companies (including, for example, by way of a co-branded or private-labeled website) that offer their products or services on our Site (“Third-Party Companies”), and you may be asked to transact directly with those Third-Party Companies relating to your purchase of tickets or booked travel. As a result, we may disclose your Personal Data to the Third-Party Companies that co-brand their products and services on our Site. Because we do not control the privacy practices of Third-Party Companies, you should read and understand their privacy policies.

Future Business Transfers

Our business is constantly changing. In the event XNow goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your Personal Data will likely be among the assets transferred.

Compliance with Law and Protection of XNow

We reserve the right to disclose Personal Data in order to comply with the law. We may also disclose Personal Data to enforce or apply the terms and conditions applicable to our products and services, or protect the rights, property or safety of XNow, our users, partners, or others.

De-Identified Data

We may share aggregated or de-identified information (anonymous), which cannot reasonably be used to specifically identify you.

Consent

We collect, use, and disclose personal information with your knowledge and consent, except where otherwise permitted or required by law.

For Canadian residents, this includes meaningful consent under the Personal Information Protection and Electronic Documents Act (PIPEDA).

Notwithstanding the above, your mobile phone number and any consent you provide to receive text messages from us will only be used for communications from XNow. We will never sell, rent, or share any of your SMS opt-in information with third parties.

You may withdraw consent at any time by contacting us at help@xnow.com; however, withdrawal may limit your ability to use certain services.

Analytics Services Provided by Others

We may allow others to provide analytics services on our behalf across the Internet and in applications. These entities may use cookies, device identifiers and other technologies to collect information about your use of the Site and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, information about your location, and conversion information. This information may be used by XNow and others to, among other things, analyze and track data, determine the popularity of certain content, and to deliver content targeted to your interests on our Site.

Your California Privacy Rights

California law permits residents of California to request certain details about how their information is used, stored, and shared. If you are a California resident, you may have certain rights. Specifically, the California Consumer Privacy Act (CCPA) may permit you to request that we: (i) provide you the categories of personal information we have collected or disclosed about you in the last twelve months; (ii) the categories of sources of such information; (iii) the business or commercial purpose for collecting your personal information; and (iv) the categories of third-parties with whom we shared personal information. Additionally, it requires that, upon request, we provide access to and/or provide a copy of certain information we hold about you, and, upon verified request, correct or delete certain information we have about you. You also have the right to opt-out of the sale or sharing of your personal information to third parties and to request that we limit the use and disclosure of sensitive personal information. Please be aware that should you make a reasonable request for information we hold relating to you, your Personal Data, or your Personally Identifiable Information (as defined in the CCPA), we will request proof of identity from you to prevent unlawful access by third parties to your protected information. Should you issue a request for us to delete or limit our activities with your information we may suspend or delete your account out of necessity in order to abide by your request. Any request will be acknowledged within 10 business days and fulfilled within 60 days.

In the event that you are in a state with the same or similar laws to the CCPA, we will do our best to honor that state’s requirements. Please send us a note identifying what state you are a resident of, the applicable statute or regulation, and your request under such statute or regulation.

Your Choices


How You Can Access or Change Your Personal Data

XNow understands that you may want to change or access your Personal Data. To change your Personal Data, sign in and go to your “My account” page. You may submit requests to gain access to, correction of, or deletion of your personal information by contacting help@XNow.com.

Canadian residents may also file a complaint with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or the applicable provincial privacy authority.

We will respond to verified requests within the time limits required by law.

Email

If you would prefer not to receive notices of special savings or promotions from XNow, you may simply opt-out from receiving them by accessing the “unsubscribe” link included within any email and/or contacting XNow administrators at help@XNow.com. Please note that, even if you opt out of promotional emails, we may still send you administrative and service-related communications.

Create a Spouse Account, Invite-a-Friend to Buy a Ticket, or Refer a Friend

  • Spouse account. We allow you to create a spouse account for a spouse who may not otherwise be eligible to access the Site. If you choose to enable a spouse account, we will ask you for your spouse’s name, email address and other information. We will automatically send your spouse an email inviting him or her to visit the Site and to create an account. The spouse account is conditioned on the eligible user’s account being in good standing. We may send follow-up emails to make sure your spouse is aware of your invitation to create an account.

  • Invite friends to join you and purchase a ticket to an event you are attending or to join you on booked travel. Our Site allows you to invite friends (InviteMore™) to attend an event for which you also purchased a ticket or booked travel through us. Your invitees will be able to pay separately for their tickets and you determine who is invited, whether friends can add to your invite list and other features to enhance the social experience of your event or travel booking. We will automatically send your invitees an email inviting them to visit the Site and RSVP to your invite, and we may send up to three follow-up email invitation reminders. We store this information for the purpose of sending your invitation emails and tracking the RSVP and ticket purchase activities. We will not send your invitees emails beyond your invitation request. Your invitees may contact us at help@XNow.com to request that we remove this information from our database.

  • Refer a Friend. You may use our referral service to tell a friend about our Site. We will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site and may send up to three follow-up emails. XNow stores this information for the purpose of sending these emails and tracking the success of our referral program. Your friend may contact us at help@XNow.com to request that we remove this information from our database.

Cookies

You can always choose to not receive a cookie file by enabling a browser to refuse cookies or to prompt you before accepting a cookie. By refusing to accept cookies, you will not be able to take advantage of certain features and functions of our Site.

Location Information

You may be asked to consent to the Site’s collection of location information. If we collect your location information, you can subsequently stop the collection of this information at any time by changing the preferences on your mobile device. You may also stop our collection of location information by following the standard uninstall process to remove all of our mobile applications from your device.

Protecting Your Personal Data

As part of our efforts to prevent unauthorized access to Personal Data, maintain data accuracy, and ensure correct use of information, we will employ reasonable and current Internet security methods and technologies. However, no security system is impenetrable. We cannot guarantee the security of our servers, nor can we guarantee that your Personal Data will not be intercepted while being transmitted to us over the Internet.

A Special Note about Children

We do not intentionally gather Personal Data from visitors under college age or seniors in high school. If a child under 15 submits Personal Data to us and we learn that the information is of a child under 15, we will attempt to delete the information as soon as possible. We do not knowingly collect personal information from children under 13 (or under 14 in Quebec) without verifiable parental consent. If we become aware that such information has been inadvertently collected, we will delete it promptly.

Visiting our websites from outside the United States

If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. This Policy and the storage, use and disclosure of your information under this Policy, is governed by the laws on the United States and Canada. ExperienceNow processes and stores data primarily in the United States. For Canadian residents, personal data may be transferred outside of Canada for processing and storage. While such data is subject to the laws of those jurisdictions, we maintain contractual and organizational safeguards to ensure equivalent protection consistent with Canadian law, including PIPEDA and Quebec Law 25. The Services are controlled and operated by us from the United States and you expressly waive the application of any laws of any territory other than the United States or Canada. The data protection and other laws of the United States and Canada and other countries might not be as comprehensive as those in your country. By using our Services, you understand and agree that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy, and the laws of the United States apply to the use, storage and disclosure of your information.

No Rights of Third-Parties

This Policy does not create rights enforceable by third-parties or require disclosure of any personal information relating to users of the Site.

We share personal information only with trusted third-party providers necessary to operate our services, such as payment processors, eligibility verification partners. All vendors are bound by confidentiality and data protection agreements that meet or exceed applicable U.S. and Canadian privacy requirements. We do not sell or rent personal information.

We may engage third-party service providers—including identity/eligibility verification partners, payment processors, analytics providers, and customer communication platforms—who may process personal information in jurisdictions outside the U.S. or Canada.

We require such providers by contract to protect personal information in a manner consistent with applicable Canadian and U.S. privacy laws and to process it only for the purposes we specify.

Amendments to this Privacy Policy

If we decide to change our Privacy Policy, we will post the updated policy within the Site and Eligibility Application, on this page, and/or the homepage of the Site, and/or other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We reserve the right to modify this Privacy Policy at any time, without prior notice being given, so please review it frequently. If we make material changes to this Privacy Policy, we will notify you here, and/or by email, and/or by means of a notice on our homepage.
